TR-001 passes its pattern test: what comes next
Reseated’s Trade Council has found that reports about trade-rule burdens meet its five-part pattern test. Its proposed Small Importer Standard would call for size-based thresholds, plain-language guidance, phase-ins and clearer landed costs—but it has not yet been drafted, consulted on or adopted.
What happened
On 20 October 2026, Reseated’s Trade Council recorded that TR-001 had passed its pattern test; the issue includes the effects of the EU’s CBAM simplification, which sets a 50-tonne annual mass threshold from 1 January 2026.
- The European Parliament’s announcement describes a 50-tonne annual mass threshold for the EU Carbon Border Adjustment Mechanism from 1 January 2026. It says the change removes about 90% of importers, mostly small and medium-sized businesses, while leaving about 99% of emissions in scope.[1]
- Reseated’s Trade Council proposal asks for size-based thresholds, plain-language guidance and phase-ins when new trade rules or tariffs apply, and for forwarders to make landed costs transparent.
- The UK Late Payments Bill exempts import/export contracts, according to the dossier. That is one case of how a rule intended to address a business problem may not cover cross-border transactions.
What it means for small businesses
A threshold can reduce the number of smaller firms required to deal with a reporting or compliance regime without removing most of its intended coverage. The details of each rule still matter, including who qualifies and what obligations remain.
Trade-rule changes can affect owners differently depending on their country, the goods they import, their shipment size, and the contracts and services they rely on. A threshold in one jurisdiction is not a general exemption elsewhere.
Passing a pattern test is an evidence-review milestone, not an adopted standard. TR-001’s next steps include developing a draft fix and putting it through consultation and an Assembly ballot.
